What does Uncontested Divorce mean?
If you and your spouse have children, born of the marriage, then you have agreed on all custody, visitation and support issues. We often hear people say we are sharing custody so no child support will be exchanged. Please be mindful that all parties are required to fully comply with the Alabama Child Support Guidelines and that we can give you advise as to how the CS Guidelines apply in your specific situation.
If you have assets such as a home, automobiles and personal property then you have fully agreed on a division of those assets. Please know that the divorce documents will not alter your loan agreements with your financial institutions. To modify or change the responsible party on a loan the loan will need to be refinanced in many cases. Also, we have many cases where the car is financed in one party and the other party will be awarded that vehicle. We can draft the settlement agreement to address those specific issues.
If you have joint marital debts then you have agreed on a division of the debts, as who will be responsible for which debts and also what happens if one fails to pay as agreed.
To qualify to file for an uncontested divorce in Alabama either you or your spouse must have been a resident of Alabama for a minimum of 6 months prior to filing divorce documents with the court. You will be asked to provide verification of Alabama residency by providing a state issued identification or other proof of residency.
